TASK 1 – PROCUREMENT METHODOLOGIES Undertake a case study analysis of a major project of your choice that has been procured using an innovative procurement system (eg. Public Private Partnerships (PPP), Project Alliancing, etc.) The case study analysis should cover the following: i) Overview of Project ii) Outline of procurement system used and project structure iii) Main innovative features of system iv) Main participants v) Contractual links and lines of communication amongst project participants vi) Method/s of project financing. vii) Tendering Process (Contractor/Consultant Selection Process) viii) Benefits/Problems of procurement system used and the identification of any major issues relating to the project iv) Project Outcome (if completed) or Current Progress (if still underway) x) The lessons learned xi) Your personal reflections on the suitability and effectiveness of the procurement system used, the main issues/problems encountered and your recommendations to address these issues/problems in the future TASK 2 – BUILDING CONTRACTS: COMPARATIVE ANALYSIS i) Superintendent Role ii) Nominated Subcontractors/Suppliers iii) Latent Conditions iv) Occupational Health & Safety v) Variations vi) Payments vii) Time Extensions & Delay Cost Claims viii) Practical Completion & Defects Liability ix) Dispute Resolution The analysis should conclude with your reflections on the main advantages and disadvantages of each contract generally and then specifically in relation to the contractual areas chosen for analysis. TASK 3 – BUILDING CONTRACTS: COMPARATIVE ANALYSIS. The claim should be prepared in accordance with the contract and include any notifications required under the contract. Reasonable assumptions can be made to complete the claim (if necessary). The focus will be placed on the professionalism of the presentation of the claim, it’s compliance with the contract, the supporting details substantiating the claim and the accuracy of the amount and time extension claimed. TASK 4 – REPORT ON BUILDING DISPUTE & CONTRACTUAL CLAIM You are required to prepare a Report on a major dispute that occurred on a construction project as a result of a contractual issue. This must relate to an actual case and must involve a dispute that was protracted and difficult to resolve. You need to identify the case and then interview a construction professional (project manager, contract administrator, quantity surveyor, etc.) who had significant involvement in the dispute. Based on the results of this interview and further investigations you are required to provide the following in your report: i) Type of project and value/size ii) Type of procurement system used iii) Actual contract used (noting any special conditions or adjustment of clauses that related to the dispute – if any) iv) Description of the problem/dispute and outline of the firms/professionals/contractors involved v) Identification of the contractual clauses related to the dispute vi) The chronological history of the dispute vii) The approaches used to resolve the dispute and the problems encountered viii) The outcome of the dispute ix) The lessons learned x) Your personal reflections on the case and your recommendations to prevent a similar dispute/problem arising in the future
