This piece of assessment is in two parts. Please read the information about word counts, marks and structure carefully so that you understand the tasks set. Part I of the assessment requires you to prepare a letter of advice for a client who has separated from her partner, based on the current law. The information about this hypothetical family has been written as instructions from the mother. Remember, this is only one side of the story, and the father will no doubt paint a different picture for his lawyer. The facts are quite detailed to give you some real insight into this fictional family. All of the facts can be used in considering your advice.

Your letter of advice must address the client personally and, therefore, should be written in the first person (ie. ‘I advise you to consider ...’) and use plain English. However, it must also demonstrate your knowledge of the relevant legislation, cases, other materials, processes and procedures applicable to your client’s circumstances. Use the facts – and explain and apply the law. You will need to provide a range of possible outcomes – including what may happen during family dispute resolution processes and what kind of order a court may make if the matter proceeds to litigation. 

For Part I you must provide footnotes and a bibliography (even though this does not actually happen in a letter of advice in a family law practice). Think of the text as being for your client and the references as being for your markers. Footnotes must not be lengthy. They should simply point to the source – with a few words to explain its relevance where required.

Part II is a reflection of how your advice to the client might be different after the Family Law Amendment Act (No 87 of 2023) becomes operative on 6 May, 2024. Please ensure that that you read the FINAL version of the Act in answering this question. It is on Canvas in the assessment module. Part II is not written to the client. It is simply a reflection for your markers on how things may or may not change.
