Consider the following fictional case study:
Ernesto has recently been released from custody after serving a 4-year sentence for inflicting grievous bodily harm (GBH). Ernesto, 41, is of British-Caribbean descent who prior to his custodial sentence worked as a contractor in local projects and was actively involved in the recreational activities of the Cuban community club in his area. Ernesto was sexually abused as a child and, following the death of his father, had to work different jobs and leave education at an early age to support his two younger brothers and epileptic mother. Before his imprisonment, he lived with his partner and adopted child from another civil partnership; Oliver, his current partner, agreed to look after the child on his own while Ernesto was held in custody.
His offending behaviour has involved violent and verbal assaults against his partner as well as co-workers. Ernesto has had a history of violent, abusive, and manipulative incidents that his pre-sentence report linked to substance misuse and anger management issues. Oliver was verbally and physically abused by Ernesto on multiple occasions during their cohabitation but continued living with him because Ernesto threatened Oliver that if he ever left, he would harm the child as a revenge. Ernesto was also verbally abusive towards his colleagues at work and when a staff member confronted him about his behaviour, Ernesto attacked him and broke his leg which led to the aforementioned grievous bodily harm (GBH) offence under section 20 of the Offences against the Person Act 1861.
While Ernesto was in custody serving the above sentence, Oliver found letters and emails confirming Ernesto’s membership to a radical religious group to the gatherings of which Ernesto was taking the child against the child’s will. Oliver is now concerned about his safety and the child’s welfare and risk of radicalisation and as Ernesto is about to go under the supervision of the Probation Service due to his risk of reoffending, Oliver has requested for an exclusion zone to be imposed. Ernesto has opposed this because he wishes to resume living with them, and the exclusion zone also means he will have to find alternative accommodation and employment and will not be able to visit his brothers or mother who live in the same area.
By reference to models, practices, and programmes of rehabilitation, resettlement, and diversity, explain how you would manage Ernesto in the community as his probation officer. Your report must be supported by application of the relevant theories and academic opinion on the suitability and limitations of these models and practices to the above case study.
