Abstract

Domestic violence—the physical and/or psychological abuse of an intimate partner is a major public health problem of concern both to the medical and legal professions. As the The 2012 World Health Organization report notes that partner abuse lead not only to physical injury but also to severe effects upon the mental health of its victims, including an erosion of self-esteem, depression, anxiety, alcohol and drug abuse, as well as suicide, (www.who.int). It also affects the capacity of women the world over to participate as equal and productive partners in their society, economy, and polity. Addressing this problem clearly requires an approach that combines a variety of remedies; legal reforms, public education, and individual psychological change are all necessary. But the remedies that are both possible and likely to be effective in a particular setting must be sensitive to the context in which the violence occurs (Bowman, 2003).

Domestic violence is one of the most common crimes that occur throughout society; it seems that it occurs in almost all cultures and countries across all known divisions of wealth, race, gender and social class. The Domestic Violence Act 118 of 1999 has been regarded as the tool that is aimed at addressing domestic violence through its Interim Protection Order (IPO) and the Protection Order (P.O). The P.O. as will be referred to in the rest of the study, it is the tool that is aimed at protecting victims of domestic violence from physical, sexual, emotional, verbal, financial abuse as well as to prevent the perpetrator from entering shared property or place of victim’s work.
