Mr X is an executive manager for Old Mutual Pty Ltd. His office is located at the 30th floor in his employer’s Sandton Centre Offices. In terms of his employment contract, his working hours are 06h30 am to 15h00 pm. However, sometimes he works flexi hours. On the 20th of February 2020, he was required to come in early to prepare for a meeting. Whilst he was standing in a lift in the Sandton Centre travelling up to his office situated on the 30th floor, the lift fell about 7 floors and Mr X died as a result of such an accident/incident.

Questions

1.1 Assume that Mr X died 10 years ago from the same lift incident and an inquest was conducted immediately after his death. His family now wants to re-open an inquest. With reference to case law, advise his family about the procedure involved in re-opening an inquest.

1.2 Assume that during an inquest of Mr X, the learned magistrate committed a gross irregularity by failing to record his correct identity, the correct date of his death and informing his spouse or relative about the holding of an inquest. Are these acceptable grounds for a review of Mr X’s inquest? Please refer to case law.
