Locate and critically analyse the judgment handed down on 6 August 1998 involving the litigant Bateman's Bay Local Aboriginal Land Council. Locate the full text version of the authorised report of this case.

You are required to critically analyse the decision made by the court, its application of previous legal precedents and its treatment by subsequent cases. In order to conduct this analysis, you will need to research the case, the legal authorities referred to within it, and the wider consideration of the case in other judicial decisions and the academic literature.

Question

2 Identify:

8. Imagine you are a lawyer acting for Rachel Green.

Consider the following factual scenario:

Rachel Green owns two pharmacies located in the Perth suburb of Floreat. Both pharmacies supply pharmaceutical benefits (ie pharmaceutical drugs and medicines) pursuant to approvals granted under the National Health Act 1953 (Cth) ('the Act').

On 10 January 2024, Ross Geller applied for approval under s 90 of the Act to supply pharmaceutical benefits at premises situated in the Perth suburb of West Leederville. West Leederville and Floreat are separated by the suburb of Wembley. Ross' premises are situated approximately four kilometres from one of Rachel's pharmacies, and approximately three kilometres from the other.

On 31 January 2024, the Secretary of the Department of Health rejected Ross' application. Subsequently, on 14 February 2024, Ross requested that the Minister for Health exercise his discretion under s 90A(2) of the Act to grant the approval, effectively substituting for the Secretary's decision a decision in favour of Ross.
Section 90A(2) of the Act applies where the Secretary has rejected an application made under s 90 for approval to supply pharmaceutical benefits at particular premises. Section 90A(2).
