Australian Architecture Engineering and Construction Engineering Assignment Help

UNIT LEARNING OUTCOMES FOR THE MAJOR ASSIGNMENT

  • Once you have completed this assignment you will be able to:
  •  Demonstrate your understanding of the legal framework of complex infrastructure/building projects within the Australian Architecture, Engineering and Construction (AEC) industry
  •  Demonstrate your understanding of the legal impact of different risk related to complex projects and contract conditions
  •  Demonstrate application of your critical analysis skills in identifying potential impacts of breaching contract, employment and Industry Relations (IR) laws
  •  Apply the principals of legal risk management in order to make recommendations to solve problems in construction projects

ASSESSMENT TASK 1

Contracts are important for establishing the relationship and responsibilities of the parties involved in a construction contract. They also help to apportion risks between the parties and manage performance.

• In a well-referenced essay, review the importance of choosing ‘right-for-purpose’ contracts to adequately deal with the type of risks expected on different projects. Support your essay with appropriate scenarios or examples.

• Discuss the limitations of construction contracts in reducing ‘opportunistic’ and ‘adversarial’ behaviour on traditional fixed-price design-bid-build projects. Design-bid-build here refers to projects where the different parties are engaged to undertake the design and construction parts of the contract.

ASSESSMENT TASK 2

Major capital intensive projects involving several stakeholders typically present complex risks that are difficult to manage effectively. This often leads to expensive cost overrun and schedule slippages. Using the case study of the ongoing West Gate Tunnel project in Victoria.

• Briefly present the project context and scope

• Review the contractual framework adopted for the project and discuss the possible legal risk that the contract environment might present to the client and contractor.

• Identify and discuss 3 possible risks related to the construction phase only of the case study project. Detail the possible consequences of the identified risks and propose possible legal instruments/clauses/tools clients can adopt to limit their exposure to those risks.
