Noberto is a 25-year-old-citizen of East Timor who is employed on a gas and oil installation located about 150km southeast of Beaço in East Timor and 450km northwest of Darwin in northern Australia. The site is currently managed by the Petroleum Organisation (PO), an Australian based company that exports gas and oil. PO is currently extracting petroleum under a petroleum production licence granted under s 163(2) of the Offshore Petroleum and Greenhouse Gas Storage Act 2006 (Cth) in January 2021. Recently, The Minister for Home Affairs, the Honourable Karen Andrews MP, exercised her ministerial powers under s 9A(6) of the Migration Act 1958 (Cth) (the Act) and enacted the Petroleum Organisation Ministerial Determination 2021 (Cth) (The Determination). Clause 4 of the Determination provides: For the purposes of s 9A(5)(a) of the Migration Act 1958 (Cth), any current operation conducted by the Petroleum Organisation is not a regulated operation for the purposes of section 7 of the Offshore Petroleum and Greenhouse Gas Storage Act 2006 (Cth). Recently, Noberto has become concerned with the question of whether he requires an Australian visa for the purposes of his employment.

1) Does Noberto require an Australian visa to lawfully work on the Petroleum Organisation site under Australian law? In your answer, please address the following issues:

a) Whether the gas and oil installation operated by the Petroleum Organisation is part of the Migration Zone for the purposes of the Migration Act 1958 (Cth) (20 marks); and

b) The validity of the Determination by the Minister for Home Affairs (20 marks)
