Previously, the ABCC had the authority to investigate, enforce and prosecute any potential breaches of the Building and Construction Industry Act or the Fair Work Act regarding the building and construction industry. Able to intervene in proceedings in the courts or Fair Work Australia involving building industry participants, the ABCC also had wide powers to enter worksites, question building industry participants and require the production of documents.
