Company overview: Huawei Investment & Holding Co Ltd (Huawei) is an information and communications technology (ICT) company that offers a wide range of enterprise and carrier products and is headquartered in Shenzhen, Guangdong province. The company was founded in 1987 by Ren Zhengfei. Initially focused on manufacturing phone switches, Huawei has expanded its business to include building telecommunications networks, providing operational and consulting services and equipment to enterprises inside and outside of China, and manufacturing communications devices for the consumer market. Lawsuits: 

Recent legal proceedings initiated against the company could hamper its brand recognition. In June 2018, SolarEdge Technologies, Inc. filed a patent infringement suit against the company and its Germany based distributor Wattkraft Solar GmbH in the Regional Court of Mannheim in Germany. The company was alleged to infringe SolarEdge’s solar DC-optimized inverter patented technology. In July 2018, it again extended its lawsuit against Huawei by alleging infringement of two additional patents that were based on HD-wave inverter technology and power inverter technology, including EP 2135348 B1 and EP 2859650 B1. It claimed for necessary monetary damages and also called for a ban on the sale of its existing suite of solar products in Germany market. In August 2017, Creative Technology and its subsidiary, QMax Communications filed a lawsuit against Huawei in Beijing court, China. The lawsuit alleged misrepresentation and breach of contract by Huawei. It sought to recover wasted payments made (US$9.4 million) to Huawei and US$19.5 million to various third parties for installation, leases and other operating costs, blaming Huawei for miscalculating and misrepresenting the cost of the network. In response to Creative's tender, Huawei submitted a proposal to design, build and operate a WiMax network. The High Court, in a judgment, found Huawei liable for misrepresentation. Huawei was also held, in the alternative, liable for breach of contract. It was ordered to pay US$9.3 million and US$15.6 million with interest, totalling US$36 million, and its counterclaim was dismissed. These costs of the proceedings were awarded to Creative and QMax. 

Data Piracy Allegation: 

Long-standing data piracy allegations against the Chinese telecom and IT technology equipment manufacturers could hamper the company’s perspective of ease of doing business. In August 2018, the company’s components were forbidden to be utilized in any US government and contractor operations as a part of the Defense Authorization Act. The new Defense Authorization Act also directed the US government agencies not to allow any essential component of any system that is used to view user data and also allocate funding to companies which need to replace the existing equipment in their systems. In the past, allegations were surfaced against the company regarding security flaws detected in its microprocessors that were vulnerable to spying and breaching user personal information. In the same month, Huawei was banned by the Australian government to supply network hardware to roll out 5G network infrastructure due to detection of several security loopholes in 5G technology, the safety of hardware and technical equipment and cybersecurity-related issues. In September 2018, the company was debarred from conducting 5G trial tests in India. In April 2018, the British government also ordered its government agencies, technology firms and other companies not to purchase telecommunications equipment from Huawei citing concerns against damaging potential for espionage.
