Background

Evangeline Summers is a 21-year-old design student at Bathurst University. Evangeline has no prior criminal record, but is currently on bail for matters relating to her ex-boyfriend, Clive. After their breakup in March, it is alleged she sent hundreds of text messages to him, some including threats to harm him. It is further alleged that in April she followed him home from the pub one night and after a verbal confrontation she started hitting him repeatedly with her umbrella, leaving lacerations and bruising on his face.

She was charged with:

  • Stalking or intimidation with intent to cause fear of physical or mental harm per s13 of the Crimes (Domestic and Personal Violence) Act 2007 (NSW) (5 years max),
  • Assault occasioning actual bodily harm per s59 of the Crimes Act 1900 (NSW), (5 years max), and;
  • Using a carriage service to menace, harass or cause offence, per s474.17 of the Criminal Code Act 1995 (Cth) (5 years max)

She works part-time at a local café, The Coffee Parlour, and is dependent on that income to pay her rent of $350 per week. She studies 3 days per week between 9-5. She is a single parent of a three-year-old child who resides with her. Evangeline's mother used to help out with childcare but has recently been diagnosed with cancer and is now unable to provide care. Evangeline has been helping her mother get to and from treatment and doctor's appointments in Sydney. Evangeline is also a member of the Bathurst Angels Netball club and helps coach the juniors team.

Offence

Evangeline has been charged with supplying a prohibited drug, being 0.5g of fentanyl (15 years max) under s25 of the Drug Misuse and Trafficking Act 1985 (NSW). The Police facts state that a second person, John, was arrested last night on the main street of Bathurst in possession of the fentanyl. Upon John's arrest, he was asked where the drugs came from. John told the police, "that young woman with the nose piercing who serves coffee at the Coffee Parlour gave it to me for $300, I can't remember her name". Police allege that that the person John is talking about must be Evangeline because she is the only person with a nose piercing that works at the Coffee Parlour. She was arrested and she has denied any involvement in the supply of the drugs.
