Assignment Task

Scenario

Malka Horowitz is a 58-year-old Israeli citizen. She normally lives in Jerusalem. Malka is widowed and has just one child. Her daughter, Ariel Horowitz, is a 34-year-old Australian citizen. She has lived in Australia with her husband and two children for the last 6 years.

Ariel visits your office for a consultation. She tells you that her mother lives alone in an apartment. She spent her adult life tending to the household and caring for Ariel whilst her husband worked as the CEO of a company. Upon his death in late 2022, Malka inherited a sum of 360,000 Israeli Shekel (AU$ 150,000) and the apartment she lives in. She is not old enough to receive a pension but is unable to find employment to supplement her savings.

Malka is currently in Australia visiting Ariel and her family. Ariel tells you she was not optimistic when she helped Malka lodge the subclass 600 (tourist stream) visa application but was surprised and excited when it was granted. She paid for Malka’s flight and of course all her expenses here in Australia so she would have the chance to see her grandchildren.

Malka loves being here, helping around the household and caring for the children while Ariel and her husband Philip are at work. Ariel earns $95,000 in her administration job at the Prince Charles hospital and Philip earns $100,000 annually as a specialist nurse.

Now, Ariel comes to see you, wanting to know what visa options there may be for Malka to obtain permanent residence. Malka wants to sell her apartment and move here permanently as soon as possible.

You have checked her visa grant letter and note that there is no condition 8503 imposed on her current visa. You also make a note of the visa expiry date (16/08/2024).

Task

Prepare an internal memorandum of your research, outlining the requirements for Malka to be granted a Contributory Parent Migrant (Class CA) subclass 143 visa.

Be sure to include information about:

  • The relevant eligibility criteria.
  • Your assessment about whether a successful outcome is likely.
  • If there is any further specific information that you need to ask for, to ensure your advice is thorough and complete.

The only validity requirement that you should discuss is the visa application charge . This may be an important consideration for the family.
