When construction was shut the usual construction rubble – planks and stones and dirt and empty drink bottles and other rubbish were left on site. On the wire fence, which is built around the outside the pool, there is a sign that says ‘Trespassers Beware: Enter at your own risk’. Kai, a 13 year old local, has been using the empty pool as a skateboard rink. Kai has been givenspecial permission by Games Infrastructure to use the site given his plans to make the 2024 Paris Olympics as a skateboarder. The pool is usually patrolled by Jenny, a security officer employed by Games Infrastructure. Jenny feels sorry for Kai as she has often seen a gang of older and larger kids hang around outside the fence and call Kai names like ‘Tony Bork’ and ‘Tony Dork’. The leader of this gang is Danny. Jenny has never intervened to stop this conduct despite seeing it on numerous occasions. On the 10th September 2021 Kai had set up an elaborate ramp over the deep end of the pool. The ramp was made of old planks lying around the pool, Kai had never done this before- indeed it was not part of his Olympic training –however the planks looked perfect for the purpose. He jumps onto it on his skateboard and falls 15 metres onto the concrete below. Kai is severely injured. His parents must modify their home with ramps and other accessible equipment to allow Kai to live more easily in his wheel chair. Jenny was sipping her latte watching Kai and saw Kai build the ramp and then saw Kai fall. As a result Jenny now suffers from PTSD. She feels enormous guilt and thinks she should have stopped Kai building and using the ramp. Jenny has sent a note to Kai’s parents apologising and stating that she knew it was the wrong thing at the time. Jenny now cannot work. After the accident Jenny tells you she remembers Danny and his gang hanging around outside thefence. Jenny says she heard Danny shout out ‘Kai your parents just died in a car accident’ and then saw Danny throw a stone. This stone hit Kai on the shoulder just before he fell. Jenny also says that she saw Danny jam the fence shut using an old plank. The fence was jammed shut from the outside and Jenny couldn’t get out. She was stuck inside the fenced area after the accident for 20 minutes. Jenny couldn’t get help during that time. It has been established by a panel of medical experts that this time would not have made any difference to Kai’s injuries.
