The criminal justice system in NSW includes a layered court system based on hierarchies and jurisdictions. These include local courts, district courts, the Supreme Court and the High Court. This task encourages you to exercise a certain amount of initiative and reflection. It is intended to introduce you to the practicalities of the NSW Criminal Courts system, to provide a context for material learned during the course and to identify some of the day-to-day realities and limitations of NSW criminal courts. You can prepare your report as an essay, a briefing paper or as a personal reflection… An essay… Brief Introduction. What is the essay going to do and how will it do it? (Approximately 100 words) Body paragraphs for – Section One (450 words maximum) descriptive, and Section two (900 words maximum) analytical.
Brief Conclusion. What did the paper demonstrate? (Approximately 100 words) OR…A briefing paper… The issue. What is the issue/question your briefing paper is about? (100 - 150 words)
The NSW Criminal Courts system. Describe it. (450 words) Your analysis of the issue. Why is it an issue, why is it important? What is the problem? (850 words) Recommendation/Conclusion. What should be done about the issue. (100 – 150 words) OR…A personal reflection… This is one of those rare times when it is acceptable and appropriate to speak in the first person. A hypothetical example – “I have struggled with the suggestion that the courts are overwhelmed with procedural matters. While Smith 2019 argues that 80% of District court sitting hours are spent on legal arguments, motions, taking appearances, the swearing of witnesses and on adjournments, I think that these are essential elements in ensuring that “justice” prevails.” Please note – an entirely subjective reflection is not acceptable. You need to reflect on a substantive issue and substantive arguments made by others.
