Highlights
1. Learning Outcomes Tested
In order to complete the module successfully, students are expected to be able to: -
To demonstrate in-depth knowledge of the theory surrounding the contractual arrangements required to enable critically evaluation of commercial relationship management.
To demonstrate in-depth knowledge of the theory surrounding legislative and regulatory issues, by critically evaluating the processes involved in a commercial agreement for the supply of goods and services.
2. Assignment Aim
The aims of the module:
This module therefore aims to provide students with a thorough understanding of the theoretical context of the any commercial and contract management approaches, (i.e. integrative or distributed), involved in the preparation and implementation within a customer supplier relationship.
This theoretical underpinning will be synthesised with practical knowledge gained
from industry through a variety of examples of the practice from the current commercial environment.
3. Assessment requirements
The assessment is through coursework only and will be in the form of a written assignment(s) constituting 6,000 words maximum or two 3,000 word maximum assignments. The weight of the assessment(s) will be 100%.
This coursework is designed to critically assess the theory surrounding the contractual arrangements required to enable critically evaluation of commercial relationship management and also the theory surrounding legislative and regulatory issues, by critically evaluating the processes involved in a commercial agreement for the supply of goods and services.
Assignment Rationale – CW1
According to Lowe & Leiringer (2005) and more recently in 2008 and 2013, they claim that the term commercial management has been used for some time, similarly the job title commercial manager. However, as of yet, little emphasis has been placed on defining the role of commercial managers or assessing the importance of commercial management as a discipline.
Lowe and Leiringer (2005) originally presented their assertions and findings within a two?year research initiative that compared and contrasted the role of commercial managers from a range of organisations and across industry sectors, as a first step in developing a body of knowledge for commercial management.
They argued in 2005 and more recently in 2013, that there are compelling arguments for considering commercial management, not solely as a task undertaken by commercial managers, but as a discipline in itself: a discipline that, arguably, bridges traditional project management / management and organisational theories.
While the study has established differences in approach and application both between and within industry sectors, it has established sufficient similarity and synergy in practice to identify a specific role of commercial management in project?based organisations. These similarities encompass contract management and dispute resolution; the divergences include a greater involvement in financial and value management in construction and in bid management in defence /aerospace.
The journal paper by Lowe & Leiringer (2005) can be found on Bb in learning materials in ‘journals’.
Footnote
Perhaps worth noting and to reflect upon. That is, there is little or no recent evidence after 2013 to support the Lowe & Leiringer (2005 & 2013) view. Perhaps some new empirical research is required that further develops a more current body of knowledge underpinning commercial management and also, to justifying the role and practice of commercial management, as a recognised and stand-alone organisational discipline in itself?
CW1 - Task
Based upon views such as Lowe and Leiringer (2005 & 2013) above and using relevant course material and wider research, select a ‘commercial’ process / system that is relevant to procurement and supply chain management.
Critique that commercial process and explain how and why that process could be of strategic importance and value for procurement and supply in 2020 and in the future?
Where appropriate, please use examples to support, justify and enrich your answers.
CW2 - Task
Using relevant course material and wider research, critically evaluate what could be considered to be the most important and relevant contractual, legislative and / or regulatory arrangements that are involved in the procurement and supply of goods and services for an organisation in 2020?
