Task:  This assignment will be completed in groups of four. Your group will be representing the plaintiff.  Each group will create and provide the following documents: Retainer agreement addressed to your client(s).

  • Review the slides for additional information.
  • Must include all the required sections per the lecture slides (see sample in Content section for Week 4). Marks will be deducted if any one of the required sections is not included.
  • You will need to set out your own fees and calculate a retainer payment that takes into account the initial meeting and work on the demand letter.

Reporting (follow-up) letter

  • This must also enclose receipt for retainer payment (assume your client has made payment).
  • Reporting letter must advise your client what you have done to-date and what will be doing (i.e. drafting or sending demand letter)

Fact scenario: Defendants: It was fairly early in the morning on Sunday when Diana Prince was running on the beach with her dog Krypto. Krypto is a 180-lb Saint Bernard. Krypto was not on a leash as the area that they were running in was designated as off-leash. He remained close to Diana until he  spotted a squirrel. The large dog chased after the squirrel and ended up running into a display full of merchandise. Plaintiffs: Twenty-five-year-old Zatanna Zatara has a license to sell her products on the same portion of the beach that Diana was running with her dog Krypto. She sells magic products: from wands to crystal balls. She has a small display and makes a strong profit when she sells in this particular area. She was almost finished setting up that fateful morning when a ginormous Saint Bernard dog came crashing into her display, damaging many of the products. Zatanna was very upset by what has occurred. She exchanged contact information with Diana immediately after the incident. She estimates her loss is $21,000, as she also had to close up shop for the day. Zatanna decides to sue Diana in Small Claims Court for her losses

      • Zatanna has approached you to file a claim for her Small Claims Court. The representatives must provide her with the above requested documents.
      • Diana has also retained a paralegal to defend her.
  • Ensure the payment request and late fees on the retainer agreement do not violate the Collection and Debt Settlement Services Act.
  • You may make up content that is not otherwise supplied, such as date this incident occurred and client addresses.
    • Assume this process occurs over several days. Assume that you have met with your client to obtain the fact scenarios, and have sent her your retainer agreement following the initial meeting. As well, assume your client has paid the retainer immediately upon request, hence why you should prepare a receipt.
