Krypto was not on a leash as the area that they were running in as it was designated as off-leash. He remained close to her until he spotted a squirrel. The large dog chased after the squirrel and ended up running into a display full of wares. Plaintiff: Twenty-five-year-old Zatanna Zatara has a license to sell her products on the same portion of the beach that Diana Prince was running with her dog, Krypto. She sells magic products from wands to crystal balls. She has a small display and makes a strong profit when she sells in this particular area. She was almost finished setting up that fateful morning when a ginormous Saint Bernard dog came crashing into her display, damaging many of the products. She is very upset by what has occurred. She exchanged contact information with Diana immediately after the incident. She estimates her loss is $21,000, as she also had to close up shop for the day. She has decided to sue Prince in Small Claims Court for her losses.

Update: Defendant Immediately after the accident occurred, Diana took her dog to the vet. She learned that he needed extensive surgery for cuts and lacerations as a result of crashing into so much broken glass.  She was advised that it would cost her $4,500 as she does not have an insurance plan for her pet. She has advised her paralegals that she wishes to counter-sue. She wants to call Krypto’s veterinarian, Dr. Kimiyo Hoshi, as a witness. Dr. Hoshi agrees only if she can be paid more than the minimal stipend allotted by the court as she will need to close her business for the day to be in court for the hearing. In order to do this, representatives for the defendants will need to file a notice of motion. After discussing all the options with her paralegals, Diana also agrees to put forward an offer to settle first. Update: Plaintiff Zatanna has kept detailed records of her sales and business operations, which she provided to her representatives. She also has a witness, Mr. John Stewart, who happened to be in town on vacation. He lives two hours’ away and does not drive. Mr. Stewart has agreed to act as a witness if the court can cover his train ride to and from the hearing. Representatives for the plaintiff will need to file a notice of motion requesting payment of the train ticket. Zatanna is also open to hearing settlement offers. Task:  Each student will follow these task instructions:
  1. Form a group of four people. This group should be the same group from your Legal Correspondence Assignment.
  2. In your group of four people, two of you will represent the plaintiffs and two of you will represent the defendants. Please see me with details of your group members once formed.
