Part a) Cyril is a keen planet gazer. He has just purchased a state of the art Orion 10029 StarBlast 90mm telescope for use in his new sky-rise apartment. Every evening Cyril can be found at his telescope. During one of these sessions he notices Teresa, who lives in an apartment across the way, leading a yoga class in the lounge. While a little amused, Cyril moves his telescope quickly on to his search for Saturn. The following weekend Cyril trains the telescope on Teresa's large uncovered windows. There is no yoga session tonight, but she is viewable watching TV in her bathrobe. Before long, Teresa-gazing becomes the norm. Sometimes it is the yoga session, sometimes Teresa is cooking, watching TV or meditating, often scantily dressed. When Cyril tells his friends about his nightly viewing, most are eager to have a look too. As it transpires, one of Cyril's friends is Teresa's cousin. He is pretty angry when he works out that Teresa is the object of the viewing. He tells Teresa, who is furious. She wants to bring an action against Cyril.

REQUIRED: Advise Teresa as to her likelihood of success in an action in intrusion into seclusion against Cyril. 
 

Part b) Assume for this question only that the facts are those in Part a), however, Cyril has also taken some video footage of Teresa and her yoga group, which he has put up on Instagram and Facebook. The footage is an instant hit as it includes unflattering butt images when the group is in downward dog position. Television programme "Kiwis' Silly Moments" (KSM) is planning to use the footage in an upcoming episode. Teresa is horrified and asks your advice as to whether she can stop KSM airing the footage.
