All inquiries to Mr Peters, Sales Manager, on 1300 987 654 or by fax on 02 123 456.On May 12, Kinky Boots sent the following fax to Mr Peters:We accept your offer in the Morning News. We wish to order 500 pairs at $5,000 per hundred. Details on delivery to follow.On May 15, James, the owner of the retailer James's Shoes, which had several regional stores throughout Australia, sent the following fax to Mr Peters at Footloose:We refer to your notice in the Morning News and would like to purchase 2,000 pairs of knee-high boots. Our best price is $75,000 including GST and delivery. Please advise. On May 18 Mr Peters sent the following fax to James:Footloose will sell 2,000 pairs of knee-high boots for $75,000, excluding delivery. Payment by cash or bank cheque is due on delivery. Please advise. James immediately wrote the following letter to Mr Peters, which was mailed on May 19:We refer to your fax of 18th May and are prepared to meet you on those terms. Please let me know the earliest delivery date. On May 25, Mr Peters telephoned James. After a short discussion, James faxed a copy of the letter mailed on May 19. During this conversation the parties agreed that James's Shoes would take delivery of the boots from Footloose's Sydney warehouse on June 1. Referring to relevant legal principles, discuss the legal effect of each of the forms of correspondence between Footloose, Kinky Boots, and James's Shoes as stated above, and determine if a contract exists between any of the parties.

Question 2 (8 marks):Sam had a 5-year written lease of a shop in the Hunter Mall in Sydney. He entered the lease at $4000 per month at the start of 2019 and ran a successful shop. In 2020 the business was affected by decreased patronage as people were not coming into the Sydney business district due to the COVID-19 restrictions.In June 2020 Sam asked the lessor, Business Centres Ltd, for a reduced rental of $3,000 per month until the business/situation improved. He told the lessor about his business problems and his diversification to online selling, and indicated that he might have to terminate the lease early. Business Centres Ltd agreed to allow Sam to pay the reduced rent and in July 2020 Sam began to pay the new agreed rent of $3,000 per month. In December 2020 Business Centres Ltd decided to sell the Mall, with a majority of shops leased.

QUESTION 3 (10 marks):Carol is travelling around Australia in a hired campervan. She decides to put her expensive sports car into storage with Park it and We Care for it Sleepovers Pty Ltd in Sydney. Carol gives instructions for the storage fees to be placed on her credit card each month. She is handed a document that has the word ‘Receipt' printed in bold type on its face, and she is asked to sign it. Carol does so without bothering to read it. There are clauses relating to the storage of property, which include an exclusion of any liability for damage or loss to property held in storage on this document.The manager of Park it and We Care for it Sleepovers Pty Ltd later realises that the vehicle has been put in an incorrect garage unit. While moving the car to the correct garage unit he collides with a concrete column and causes considerable damage to the vehicle.
