Grace and Owen have been in a relationship for about 10 years. In 2019 they purchased a property together. They contributed different amounts to the purchase price. Grace contributed 65% and Owen 35%. This being the case, their conveyancer, Pria, advised them to own the property as tenants in common. In due course a transfer was lodged recording their shares in the property as tenants in common reflecting their contributions to the purchase price. Grace works as a consultant and can do most of her work from her computer online. She has set herself up in a spare room in the house which works well for her. Owen works in an office an hour’s commute from the property. When COVID hit, Owen was initially forced to work remotely. This meant that they had to set up two work areas in the spare room, to try and keep the remainder of the house for their personal life. As they had installed various facilities into the spare room for Grace, this then worked well for both of them.  However, after several months of remote working, Owen was advised by email that his company had to radically downsize due to COVID and that he would be made redundant. The loss of his job has placed a lot of strain on their relationship.  Owen started drinking and became argumentative. Last month, he became physically violent. Grace says that she was prepared to put up with the drinking, but she will not tolerate violence. So, she decided to leave and as result has had to rent accommodation sufficient to live in and run her consulting business from. However, Owen has required her to keep paying expenses on the property they own together as well as mortgage payments as it is in both their names.After Grace leaves, Owen decides to rent out the spare room for $250 per week. This rent helps to provide him with some income. The rent includes access to utilities including the high-speed internet and high-quality modem as well as other electronic facilities that had been set up in the spare room to assist Grace operate her online business.
