1. Grayson is an avid vintage car collector. He sends an email to his friend Hubert about the sale of his 1964 Cadillac Coupe de Ville at a forthcoming auction. He tells Hubert that he will buy the car for $21,000 and says: "Listen Hubert, you won't get a better price in the current market. If I don't hear from you, I expect you to pull the car from sale and contact me the next day about arrangements for delivery." When the auction comes around, Hubert does not contact Grayson and leaves the car in the auction list. The auctioneer sells it to another car collector. Grayson comes to you with instructions to sue Hubert for breach of contract. Advise him.
2. Celia offers to sell her vacant block of land to Imelda for $500,000. Imelda says she needs time to discuss the purchase with her bank and arrange for a loan. Celia promises to wait for Imelda's response for a period of seven days. Imelda asks: "Would you like me to pay a kind of deposit of, say, $1,000?" Celia says: "No don't worry, I'll wait for you." After six days Imelda contacts Celia and says: "Great news. The bank has approved the loan and we can go ahead with a contract for sale." But Imelda is devastated when Celia says: "Oh sorry, I assumed you weren't going ahead and I was getting anxious. I sold the block to someone else." Advise Imelda. 3
. Happy Feed, a local stock feed business, contacts the local council for help under its 'Cleaning up Business' program. The council agrees to eradicate vermin from Happy Feed's storage facilities. However, after the council workers do their work, much of the wheat and barley stock of the business becomes contaminated, causing considerable loss to Happy Feed. To make things worse, Happy Feed also responds to an advertisement in the local newspaper that council would provide a rates discount to any local business that achieves certain environmental clean-up targets. But after Happy Feed makes some costly changes to its internal processes in an attempt to reach those targets, the council publicly withdraws the rates discount plan on its website. Happy Feed seeks advice on whether there is any possibility under the law of contracts to sue council for the loss of their stock and claim the promised rates discount.
4. Harry promises John and Mary that he will give them part of his wine collection if they look after his Chow Chow dogs for a fortnight while he is overseas on a business trip. Mary looks after the dogs every day while John is at work. On his return from overseas, Harry avoids Mary and John and finally stops taking their calls. Mary is upset but does not want to take the matter any further. She says to John: "I would feel bad 'karma' if I make a fuss about this, because I love those dogs and was happy taking care of them." But John replies: "What? No way. I'm going to get my hands on the wine he promised." Advise John about his prospects.
