The court denied habeas corpus relief for Tommy and Kiko on the basis that they are not, and cannot be persons (Andrews et al. 5).  Under current United States law, an entity is either a person or a thing, and only persons bear the capacity for rights such as a writ for habeas corpus. The Nonhuman Rights Project (NhRP), which filed the petition, argues that Tommy and Kiko should be classed as persons, not things. Seventeen philosophers drafted and submitted an amicus brief to the New York Court of Appeals in support of NhRP’s effort to secure recognition of Tommy and Kiko’s personhood and capacity for rights. In Chimpanzee Right: The Philosophers’ Brief, the philosophers investigated the different conceptions of personhood, including the species membership conception, the social contract conception, the community membership conception, and the capacities conceptions. In this paper, I argue that chimpanzees should not be classed as persons for legal purposes. We should focus on developing our legal accountability for the protection of nonhuman animals from the perspective of animal welfare. I will focus on the capacities conception, especially autonomy and personhood. I will recount the “autonomy” argument in detail and then raise objections and concerns over the personhood for Chimpanzees.
