PART A Section 1: Scenario
Your friend, Lisa Daniels, is considering starting a web design business. The name of this company will be SlickWeb. To get started quickly they were considering just using clip art, images, sounds and movie clips found online. After all, it is online so anyone can use it yes? Your friend said they didn’t see any copyright warnings. You warned them that just because it is online, does not mean it is free.
Your friend has heard terms such as trademarked, copyright, intellectual property (IP), creative commons license but does not really know much about them.
Lisa would very much like to know how she can attribute copyright to her work and work her company creates that she wants to make freely available. She does not wish all work to be free just materials uploaded to the “free resources” section she is planning to have on the company website. With these free resources, Lisa wants both author of the work and the company name to be attributed. She feels the free resources could help demonstrate the company design skills. She is happy for the public to use the resources provided that Slickweb receives credit for it, they are not modified, and that people do not make money from those resources.
SlickWeb offers a variety of services including
• Web consulting
• Web design
• Web hosting
• Content management
• Asset creation – animation / video / images + photography
PART A Section 1: Your task
Research current Australian IP (intellectual property), copyright legislation and standards that would be relevant to this scenario. Remember websites are media rich so it would not only be pictures. Text content, design, sounds, video and interactive content such as SCORM objects are all subject to legislation.
Write a document to Lisa that covers the following
1. Current legislation and standards relating to intellectual property and copyright in Australia. You should include and explain 3 items of Australian legislation, one of the three must be the 1968 copyright act.
2. Explanation on how the creative commons license works. Which kind should Lisa use for the materials they are giving away for free that lets people know that attribution is required and that they would not be authorised to make money from the free materials?
3. An explanation on what their future web design business has to know regarding using clip art, images, sounds and movie clips found online. Give examples and a thorough explanation.
4. Two samples of a copyright policy from another Australian web design firm that you can show Lisa as examples. Provide a full copy of the policy (ie cut and paste it into your assignment document), the direct URL and explain the KEY sections you find in each policy. (Suggest to find small policies)
