Task:
QUESTION 1 - Offer and Acceptance:
Write an essay explaining the differences between an offer and an invitation to treat. In addition, consider counter-offers. Further, consider when we can identify acceptance when dealing with an agreement using the postal service and what the implications of silence are in Contract law. Use relevant case-law to support your writing.
QUESTION 2 - Consideration:
Please read the following problem questions. Answer the question using a coherent structure by identifying the claimants, defendant, identifying the legal issues and facts and consider the relevant remedies available.
An agreement was entered into by the Godmothers of Amelia after she graduated from school to prepare and support her financially for the future. The agreement was to build a trust fund that would entitle Amelia to an amount of £200,00 once she turned 28 years of age. The agreement was between both Godmothers and monies were placed in a trust on account for Amelia, this was based on the premise that they would both equally pay sums of money, therefore £100,000 each.
Although sadly, the maternal Godmother died in an accident whilst on holiday in Tuscany, Italy. Further, the paternal Godmother also passed away unexpectedly six-months after the maternal Godmother died, due to a significant deterioration of her neurological condition. Amelia’s fiancé, Kerem sought to bring a claim against the executor of the will for the payment the Godmothers had originally agreed on.
Critically discuss and evaluate the legal position for Amelia’s fiancé, Kerem.
In the meantime, Amelia was living with Kerem and his family temporarily at the family home in Oxford, as they prepared for their wedding and whilst looking for a family home of their own. Kerem, along with his two sisters, Elif and Filiz were beneficiaries of their father’s estate. Amelia, was a fashion journalist and decided that the study was in need of refurbishment as it had fallen into disrepair over the years and she wanted to use the room to work from home. Amelia took it upon herself to refurbish the room for her own use and used her own savings to fund the renovations. Elif, Filiz and Kerem decided after the room was refurbished that they would pay £20,000 to Amelia for this, upon their father’s death. Their father recently died, although during this time Kerem and Amelia’s relationship became strained due to living with the family and being in lock-down from the pandemic and they had decided to separate, further Kerem, Elif and Filiz did not pay Amelia for the refurbishment.
Critically discuss the legal general position, specifically as it relates to Amelia. Use relevant case-law to support your discussion.
