Incident Scenario 16 August 2018
You are employed as a Health and Safety Manager for a Dutch mining company operating several gold mines throughout Australia.  As the Health and SafetyManager, you are responsible for the development of health and safety policies and procedures, health and safety training and the investigation of any incidents. You report to the General Manager Australia, located in Perth. The General Manager reports directly to the Chief Executive Officer in Amsterdam. 
A mine, in Victoria, is in an isolated area of the Great Dividing Range, approximately 25km from the nearest settlement accessible by unsealed roads. The mine currently has a permanent staff of 85 workers. There is a contract construction company with eleven staff on the site erecting a storage facility near the mine entrance. You are on site conducting training. 
At 12.10 pm, during your training session you are alerted to an incident which has just occurred. A building under construction on the mine site (located about 500m from the mine entrance) has collapsed. Two workers have been fatally injured and a further three workers have sustained injuries, which at this stage are unknown. One of the fatalities involves a worker of the mining company who happened to be on the construction site at the time. The other workers are workers of the contractor. The building was being erected to store mining equipment.
At 7.00 am, the contractor construction company commenced work.  This started with a toolbox meeting and a briefing of the work for the day.  It also included the workers going through the safe work method statement.  At 7.35 am, the crane driver begins to start up the crane for the day’s work.  There is a delay, as the concrete wall panels required for the day’s work haven’t arrived yet.  At 8.00 am, the concrete panels arrive, and the truck is parked into position for the delivery.
Each concrete panel will be rigged to the crane and then put into its allocated on the construction site.  This technique utilises the tilt-up method of construction, where prefabricated concrete wall panels are tilted into place with a crane.
At 9.00 am everyone stops for a 15-minute break.  At this time the first panel has been put into position.  At 11.27 am a concrete panel becomes unstable and falls.  This in turn leads to the collapse of all the panels (four in total).  The slabs bring down power lines, temporarily cutting power to the mine operation. Auxiliary generators are activated 12.19 pm to restore power to the mine. 
Over the preceding weeks several concerns had been raised about the fixtures that the contracting company were using to attach the braces to the concrete panels during construction.  At a production meeting on 9 August it was documented that fixtures were not the high tensile fixtures specified by the engineers but a cheaper substitute product. At the beginning of July, the mining company had approved the fixture as it was 20-30% cheaper.
Senior staff at the mine includes the site supervisor and mine engineer.  As theHealth and Safety Manager you have been delegated authority to investigate incidents. The company's incident investigation procedure states that a formal investigation will be undertaken where the incident:
• results in injury or significant damage to plant
• results in time off work or a workers' compensation claim
• is otherwise assessed as a significant occurrence.
You arrive at the incident scene nine minutes after becoming aware of the collapse of the concrete panels.
