The Metal and Allied Workers Union (MAWU) represents 60% of all the employees at German Engineering, an aluminium extrusion plant specialising in the design and manufacturing of modular items used in shopfitting.

German Engineering is willing to grant organisational rights to MAWU as well as to a rival union of MAWU called the Consolidated Allied Metal Union (CAMU), who has recently recruited 30% of German Engineering’s employees. You are the newly appointed HR manager of German Engineering.

CAMU had served notice on German Engineering indicating their demands for all the organisational rights as per the Labour Relations Act 66 of 1995 (LRA). Write a note to the owners of the business explaining which organisational rights CAMU qualifies for. You are required to set out the reasoning why they qualify for those rights as well as to explain what the implications of those rights are for the organisation.

MAWU is furious that German Engineering is offering to grant organisational rights to their rival union.  
Thembinkosi Newell, one of the employees hoping one day to become a shop steward, called a meeting of all the union members. He gets the crowd worked up about the presence of the rival union and accuses German Engineering of bad faith bargaining, calling for all the employees to go out on strike action in protest of the company’s support of the rival union. All the MAWU members left the property immediately, dancing and shouting slogans.

Q.2.1 The owners have requested that you, in your capacity as HR manager of the company, draft an office memorandum in which you update them on the following:
-Advise them on the legality of the strike and the procedures that need to be followed in order for a strike to be protected;

-Inform them of the steps to take to get the employees to return to work and what action they may take against the striking workers in this instance.
