Assignment Task -

Instructions

You must answer two of the three questions (i.e., you can select between the options, but must submit separate answers to each of two questions). The assignment is open book, so you may ( and are expected to) refer to course materials.

The maximum word length overall is 2,000 words. You may distribute the number of words across each of your answers as you wish. The word count for each of your answers should be stated on your cover sheet. The word count includes footnotes but excludes your cover page and reference list (bibliography).

Make sure to label your answers so that it is clear which question your answer relates to. For each question you choose , you should produce a self-contained answer to that question (i.e., each answer must be able to be read alone and should not depend upon or cross-reference material contained in your answers to the other questions).

Footnotes should be used for citations. DO NOT CITE THE LECTURE NOTES. Cite only the materials and cases from the course. Students should use the most recent edition of the Australian Guide to Legal Citation (AGLC). Note that all footnotes are counted as part of the overall word count. You can use shortened names for the applicant and respondent parties to cases you cite (e.g. shortened name of case, or shortened State names).

For example, you may reference “Military and Paramilitary Activities in and against Nicaragua (Nicaragua v. United States of America), Merits, Judgment, I.C.J. Reports 1986 , p. 14” as “Military and Paramilitary Activities (Nicaragua v. USA), Merits, Judgment, I.C.J. Reports 1986, p. 14”. As such, even if you shorten the party names the shortening (i) must enable the case you are citing to be identified and distinguished from other similarly-titled cases, and (ii) you must provide all other information required under the AGLC for cases (decision name, date etc).

Please include a reference list (bibliography) which lists the sources you used in preparing your answers. The bibliography is not included in the word count for this task.

Assessment 1: Short Assignment – Ocean Plastic Waste in International Waters

A growing environmental problem is plastic waste in the world’s oceans. In particular, scientists have  identified the accumulation of plastic waste in “gyres” within each of the world’s oceans. The bulk of the  plastic waste in these gyres are lying in international waters. Such plastic waste floats near the ocean  surface, but also descends through the water column to ocean depths. Ocean plastic waste originates from  plastic consumption by the all of the world’s nation-states. However, industrialized nation-states are the  largest producers of ocean plastic waste. Scientific knowledge about the dangers of ocean plastic waste is  uncertain, but scientific research is ongoing regarding the dangers posed by such plastic waste to the global  environment and humanity.

Word limit: 2,000 words (total, including citations).

With respect to the above problem of ocean plastic waste in international waters, please apply the  principles of international environmental law discussed so far in the course to write answers to 2 of the  following 3 questions (PROVIDE CITATIONS and WRITE SEPARATE ANSWERS):

1) What would a “commons” approach say about this problem?

2) What are the potential issues in trying to make an argument for state responsibility/liability under  principles of international environmental law?
