Japhet Jones has been happily married for some 10 years to his wife, Norm The last two months have been somewhat less happy however, since Nora's ex-boyfriend, David, chose to 'look her up again after all these yeari. One day Jones comes home unexpectedly, only to find his worst suspicions confirmed, in that he catches David in bed with Nora. Overcome by anger. Jones draws his gun, which he carries with him for protection, and shoots both David and Nora dead. Jones is charged with two counts of murder. He pleads non-pathological incapacity based on provocation, but this defence is rejected by the court a quo, which holds that irrespective of the provocation, Jones ought to have acted as the reasonable person would have, and controlled his actions. 
The matter comes on appeal to this court.
