Assessment description
Social workers’ contact with the legal system can create different levels of tensions within their professional and personal environments. Amidst the legal complexities social workers are often required to work with their clients to address any form of conflicts with the law. Voluntarily of by compulsion (subpoena), social workers are required to providea report to the court to facilitate legal decision-making. Such a request require a thorough understanding of the client’s context. This assessment task provides you with an opportunity to demonstrate your developing knowledge and skills in assessing situations, making judgement on issue, synthesising information, and communicating information. This task also seeks to develop professional writing skills you will require for an effective practice. You are required to providea written court report based on the following case:
Case One: A child custody case
A single mother of two children (Charlotte) moved in with a partner (Thomas) who has a long criminal history, which included offences against children. There were reports made that the partner was abusing the children. You have worked with this family over the past one year and on recent visit you observed bruises on the older child, and you had conversations with Charlotte about the welfare of the children.
Charlotte refused to accept that her partner was a potential risk to the children, and she prioritised him over the safety, welfare, and wellbeing of the children. The children's father was contacted and said he was willing to take care of the children, but he has had little contact with them since the separation. Charlotte feels she has the right to keep the children. The matter was brought before the Children’s Court, and you have been invited to send a report to the court.
Case Two: A juvenile drug and theft case
A 15-year-old boy has been struggling with drug issues and has attended several rehabilitation programs. This has affected his education. He spends his time mostly in one rehabilitation to the other. In the last 8 months however, he has been mostly home. You have been working with him as his support worker for the 8 months he has been home. On the 25th of June, after you closed from work and left him in the care of the parents, He sneaked out without their knowledge, broke into a neighbour’s home, and made away with cash, jewelleries, and electronic items. He was arrested and arranged before a court. The court has subpoenaed you to provide a written report to help the court in making the right decision.
Approaching the assessment task – court report writing
Recognise that your court report may be intended to advocate for your client in certain matters including granting custody, leniency, increase contact with children, or as may apply to each case. Your role in this report is to share information about the social context and circumstances of the client and their story and how these relate to the given legal issue before the courtsthrough good assessment and sound judgement.You are encouraged to be creative in structing your report. However, you may consider:
Include an introduction that outlines the purpose of the report and what will becovered in the report. Your introduction should also indicate which case you have chosen and your intended outcome for your client. Do not repeat the case in your report.
Establish your credential: Indicate who you are, your qualifications, number of years of experience, and how long you have worked with this client.
Provide background information/context to the issue before the court.

Support your position and argument with relevantsocial worktheories, principles, values, and relevant legislations associated with the issue before the court.
Given your background understanding of the caseand your assessment providepossible outcome/interventions/recommendations that could support the clients. You can draw on the relevantliterature to support your position.
