In the Immigration Act 2003 Fiji (the Act), two distinct process are applied for deportation for persons designated as prohibited immigrants under section 15 and deportation under Part 7 of the Act.
In your answer you are to explain why there is two different procedures applied. Does it ensure accountability and transparency or not? You may cite recent cases and other legal resources to support your answer.

The Constitution of Fiji, 2013 establishes several constitutional officers. Out of the many one is the Electoral Commission that was established under the State Services Decree 2009 and then recognised by the 2013 Constitution in section 75 and 76 respectively.
The Electoral Act 2014 provides the specific powers of the Electoral Commission and all the Officers including the Supervisor of Elections established under the Act.
Scenario
The Electoral Commission has directed the Supervisor of Elections to carry out a specific direction, but the Supervisor of Elections refuses to do so on the premises that its office is independent of the Electoral Commission.
You are to argue whether the Electoral Commission or the Supervisor of Elections are correct in the stance they have taken and the resulting implications.
You are to substantiate or support your answer by reference to relevant laws and case laws.
