INSTRUCTIONS

In Commercial Transactions, there is only ONE ASSIGNMENT. This assignment is compulsory and must be submitted by all students. The assignment will constitute 20% of the final mark in this subject.

Assignments must be submitted by the due date unless an extension has been granted. Extensions need to be requested by email prior to the assignment due date and specific supporting evidence provided. Late assignments attract a penalty of one mark out of 20, or 5% of the total marks available, per day. A pass mark is 50%. Assignments that are received more than ten days after the published due date will not be accepted. Please note that students granted an extension must still submit their assignment within ten days of the original assignment due date.

  1. The common law of negligence

  2. Contract

  3. Statute, mainly the Australian Consumer Law (ACL)

 

Please answer the following questions in relation to C.

  1. Why are the consumer guarantees contained in Part 3-2 Division 1 of the ACL referred to as being the “strict liability” type? Please provide at least one case example to illustrate your answer. (4 marks)

  2. Who is liable for breach of a consumer guarantee? (3 marks)

  3. What is a “defect” for the purposes of the defective goods provisions under Part 3-5 of the ACL?  

  4. Who is liable for a breach of the defective goods provisions in Part 3-5 of the ACL? 

  5. Are there any defenses to a legal action based on a claim that goods have a safety defect? Please provide at least one case example to illustrate your answer. 

  6. To what extent can liability under Part 3-2 Division 1 be limited or excluded?
