Adelaide Super signed a contract with a Japanese Company called Mitoshi, and imports bread and biscuits worth of 1 million dollars, to be shipped from Kobe, Japan to Adelaide, Australia. When the ship arrives at Adelaide, Adelaide Super finds that most biscuits and bread are broken (though still edible) due to terrible weather on the way. Do you think Adelaide Super can terminate the contract with Mitoshi?

In another scenario, on her way, the ship was hijacked by pirates in Indonesia. When the ship was finally released and reached Adelaide, nothing on board is still edible. What would you suggest in this situation?
