Purpose
To demonstrate an understanding of the law as it applies to sentencing.
Learning Outcomes
• CLR 1: Research statutes relevant to the application of criminal law
• CLR 2: Explain the role of the participants in the criminal law system
• CLR 4: Describe the elements of sentencing and availability of appeal.
Instructions:
Working in your assigned groups, you and your partners will decide which of you will represent the defence, crown or judge. Analyze the scenario that you were assigned (group 1 will do scenario 1; group 2, scenario 2, etc). The defence and crown will each prepare sentencing submissions in support of their respective position.
As the judge, based on the arguments presented by the defence and the crown, and applying the appropriate principles of sentencing and the case law in support, provide your reasoned decision and issue sentence.
Defence and Crown should provide their positions to the judge in advance of your presentation so that the judge can provide a reasoned decision based on your arguments.
Note: If you have been assigned to a group of 2, you will simply present your positions on sentence from the perspective of the defence and the Crown.
The judge of each group will present the judge’s decision in class on Week 14. In all cases, the Crown has elected to proceed by way of summary conviction procedure.
Each group must provide me with their written sentencing submission and judge’s decision, through Brightspace by 6pm on week 14. To be successful in the assignment you must (for a maximum of 5 points each):

Your group number represents your scenario number. A maximum of 15 points is allocated to peer evaluation. You must individually submit your confidential peer evaluation of your other group members by email by 8:00 p.m. on April 12th.
