Task 

Purpose
To demonstrate an understanding of the law as it applies to sentencing.

Learning Outcomes
• CLR 1: Research statutes relevant to the application of criminal law
• CLR 2: Explain the role of the participants in the criminal law system
• CLR 4: Describe the elements of sentencing and availability of appeal.

Instructions:
Working in your assigned groups, you and your partners will decide which of you will represent the defence, crown or judge. Analyze the scenario that you were assigned (group 1 will do scenario 1; group 2, scenario 2, etc). The defence and crown will each prepare sentencing submissions in support of their respective position.
As the judge, based on the arguments presented by the defence and the crown, and applying the appropriate principles of sentencing and the case law in support, provide your reasoned decision and issue sentence.
Defence and Crown should provide their positions to the judge in advance of your presentation so that the judge can provide a reasoned decision based on your arguments.
Note: If you have been assigned to a group of 2, you will simply present your positions on sentence from the perspective of the defence and the Crown.
The judge of each group will present the judge’s decision in class on Week 14. In all cases, the Crown has elected to proceed by way of summary conviction procedure.

Each group must provide me with their written sentencing submission and judge’s decision, through Brightspace by 6pm on week 14. To be successful in the assignment you must (for a maximum of 5 points each):

• Make proper use of the facts of the case, being mindful of the role that you are assuming.
• Provide a minimum of 2 cases in support of your position or demonstrating a proposition that you are advancing in your submission (each student - including the judge - needs to have 2 cases that are different from those of the other group members).
• Propose an adequate sentence in the circumstances, being mindful of your role.
• Apply the principles of sentencing and explain the primary sentencing consideration at play in your scenario from your point of view.
• Explain any aggravating or mitigating factors or any other relevant factors or orders that the court may need to make (again, be mindful of the role that you are representing).

Peer assessment:
Your group number represents your scenario number. A maximum of 15 points is allocated to peer evaluation. You must individually submit your confidential peer evaluation of your other group members by email by 8:00 p.m. on April 12th. Any student who does not submit their evaluation will receive a zero grade on the peer evaluation portion of this assignment. Your peer evaluation is based on the following:

• Participation (maximum of 5 points): How available were your partners? Was it difficult to reach them? Did they participate in group discussions or were they MIA? Were they difficult to work with?
• Communications (maximum of 5 points): Were communications easy or difficult? Were scheduled meetings missed? Were your partners non-responsive?
• Research (maximum of 5 points): Did your partners assist in research? Did they find cases that were helpful for the group or a member if the group (if not themselves)?
