TASK: Read the following scenario happened between Johnny and Jin, and complete the tasks. JOHNNY AND JIN Business has been good for Johnny lately, and his vegan pizza has been particularly popular. Johnny plans to purchase a new pizza oven for the restaurant, and decides to sell his old oven for as much money as he can get. Johnny advertises the oven for sale on gumtree. The advertisement is as follows: ï‚· COMMERCIAL PIZZA OVEN - $5000 ï‚· Only 8 years old. ï‚· This large pizza oven is still in excellent condition. ï‚· Suitable for busy takeaway or restaurant. ï‚· Can be collected at any time at buyer’s expense. ï‚· Price negotiable. Johnny receives a text message from his brother in law Jin who is thinking about opening a restaurant of his own. This leads to the following text message conversation – Jin: Hi bro, are you still selling that oven? Johnny: Yeah, still for sale. Johnny: You interested? Jin: May be could we do a deal? Johnny: Such as? Jin: You give me the oven now, and I will give you half of my profit every week until I have paid $5k? Johnny: Make it 6k. Jin: Ad says $5k bro? Johnny: Come to the restaurant tomorrow Jin: Yeah! see you then! Jin arrives at the restaurant next day with a large truck that he has hired. He has brought a friend to help him move the oven. Johnny is surprised to learn that Jin wants to take the oven straight away. He thought that he and Jin is still negotiating the deal. Jin, however, believes that the deal has been finalised and he will be taking the oven now and paying $5000 later. Johnny tells Jin that they don’t have a deal. Jin is very annoyed when johnny refused to let him load the oven onto the truck. Jin shouted Johnny and as he gets back in the truck to leave calls Johnny a filthy welcher and threatened to sue him. TASKS Advise Johnny about whether or not a legally enforceable contract exists between Johnny and Jin.  Focus on the following issues. 1. Whether Johnny and Jin formed an agreement. 2. Whether Johnny and Jin intended the arrangement to be legally enforceable. 3. Whether Jin provided consideration for Johnny’s (alleged) promise to sell him the oven.  In relation to each issue, you should be able to. identify the precise legal issue ï‚· summarise the relevant legal rules, citing any relevant legislation or case law ï‚· apply the relevant legal rules to the facts of the problem ï‚· reach a justified and clearly articulated conclusion, including the practical consequences of the conclusion.
