Better Design commenced preliminary design work but after three months the parties were notified that the land has been rezoned parkland and a factory cannot be constructed on the site. XYZ notifies Better Design that the contract is now terminated. TASK3 The two directors of Better Design were aware that two special plan scanners that would be perfect for their business operations were up for auction at an auction room in Perth on May 16 in 2018. Both of them were interstate on business and asked Brian’s sister, Betty, to attend the auction and bid on the company’s behalf. They instruct her not to bid more than $50,000 for the two scanners. In the excitement Betty has the highest bid of $150,000 for the two scanners. The auction house claims that the company is liable to pay for the scanners. Advise Rita whether the company is liable on the contract arising from the auction. They do not understand consumer protection laws in Australia and are concerned that if they are sued under these laws there is a wide range of remedies and orders a court can make if they lose.Advise Rita about the range of remedies and penalties that can be imposed on businesses for unfair practices under Australian Consumer Law.
