Choose one of the following topics for your essay:
Critically assess the Jurisprudential debate between the Positivist and Natural Law traditions of Jurisprudence, with respect to;
a) the question, ‘what counts as proposition of law’?, or
b) judicial reasoning and adjudication.
With respect to a) or b) above, consider which ‘tradition’ gives the more persuasive account.

1. This essay (which counts 30% towards the year mark) is due at 9am on Friday, 10th May – please hand in two printed copies at Room 41. Both copies must be stamped by Room 41 – keep one copy for your own records; the other copy will be forwarded to your lectures for assessment.
2. Since you are getting the essay topics and instructions well in advance of the due date and are strongly encouraged to start working on the essay well ahead of the deadline, extensions will not be granted, outside of unforeseen events/emergencies (problems with printing and computers do not count, so please ensure you regularly backup your work and leave sufficient time before the deadline to print and properly check the printout before submitting it). If anyone has problems that impact on your ability to submit the essay by the deadline, please bring this to Professor Cachalia’s attention well ahead of the deadline. Late essays will be penalised by 10 percent per day or part thereof. LAWS2017
3. Essays should not exceed 1500 words, including footnotes. The word restriction is to ensure that you crystalise your arguments and do not waffle.
4. Essays must contain a cover page, indicating your student number, as well the declared word count.
5. Essays must be properly structured with headings and page numbers, as well as a bibliography with all the references that have been used in the text/footnotes (include only those sources you have cited in the text/footnotes), divided into categories such as articles, books, cases, legislation etc.
6. Essays should be typed according to the following format:
Font: Times New Roman.
Font Size: 12pt for the main text; 10pt for the footnotes.

7. You will need to go beyond the readings on the course outline and independently identify and use other academic scholarship to substantiate your arguments. The extent to which this has been done will be taken into account in the evaluation of your essay.
8. Ethical modes of referencing must be used - all sources used must be given due recognition. In this regard, students are referred to the relevant plagiarism policies. All essays must include a ‘Plagiarism Declaration’ cover sheet.
