The Sydney Water Act 1994 (NSW) (‘the Act’) establishes Sydney Water Corporation (‘Sydney Water’) as a state- owned corporation with functions of storing or supplying water, providing sewerage services and stormwater
drainage systems, and disposing of waste water. It discharges these functions under operating licences granted by the Governor.

Section 47 of the Act provides in relation to Sydney Water:

Acquisition of land for purposes of this Act

(1) The Corporation may acquire land (including an interest in land) for the purposes of this Act.

(2) Land that the Corporation is authorised to acquire under this section may be acquired by agreement or by compulsory process in accordance with the Land Acquisition (Just Terms Compensation) Act 1991 for the purposes of this Act.

(3) The Corporation may not give a proposed acquisition notice under the Land Acquisition (Just Terms Compensation) Act 1991 without the approval of the Minister.
