Smith Ltd engages Bob, an independent I.T. consultant to do the work. An agreement was signed including a term requiring Smith Ltd to give Bob two months’ notice of termination of the contract. John has been employed by the company since 2010 and has until now been a reliable employee. Under his contract of employment he is entitled to one month’s notice. However, recently he has had personal problems and is having difficulties at work. This resulted in a dispute with another employee which finally led to a fight on work premises. Tom joined the company as an employee six months ago. Tom recently discovered that one of the fitters, Sam, does not have the required qualifications to fit gas appliances and is clearly taking short cuts in the fitting procedures to speed up his appointments. Tom lets the Managing Director know. The MD is good friends with Sam so decides to get rid of Tom. The company gives Tom the required notice under his contract. Tom is outraged and is convinced that he has been dismissed because of the information he gave to the MD. The MD also decides that the IT project is costing too much and gives Bob two weeks’ notice. Finally, the MD hears about the fight involving John and dismisses him with immediate effect. Advise Smith Ltd of any claims that could be brought by Bob, John and Tom against the company in relation to employment law.
