PART A

Mr Jacob lives in Nelspruit and he works in a Partnership Company whose sole business is the selling of Land. Mr. Jacob sold a piece of Land to Mr. Banabas. In this transaction, there is a clause in the sale which provides that Mr. Jacob would pay the commission, but that should Mr. Banabas fail in his obligations which includes the payment of the principal amount of the sold Land at the stipulated time, then Mr. Jacob would be entitled to recover the commission from Mr. Banabas. Unfortunately, Mr. Banabas breached the agreement and refused to pay Mr. Jacob the commission.

Give your legal opinion on the claim and liabilities of the Parties and support your arguments with three (3) case laws.

Mr. Ntuli took his car for repair in a garage. In the process of repairing the car, there was fire in the garage that burnt the car to ashes. Inside the car garage, there was a notice on the wall  which says, “that customer cars under repair in this premises is at the risk of the owners of the car.
