Explanation of the legal system in the UK
As per the law of the United Kingdom the head of the state is the monarch not a president i.e. the UK has a constitutional monarchy. The duties and rights of monarch are described by convention. As per the constitutional convention, the monarch is politically neutral and unelected and his role is largely ceremonial. They occupy their position with the virtue of birth. The laws and legislation are established by the Parliament which also consist the Monarch, House of Lords and House of Commons. The Prime Minister is the traditional member of the House of Commons who is elected by the people. The legal system of the United Kingdom has a different system for England and Wales, Scotland and Northern Ireland. England and Wales have a common law system which depends on the creation of law through the past case laws. The system of Courts and case law are regulated by the judiciary which is not the part of Parliament. The law of the UK is divided into two major aspects which are civil and criminal laws (Countouris, 2016). The criminal law includes the offences and breaches which negatively affects the society rather than an individual. The acts and conduct under this area of law are described by the Parliament as the acts which are acceptable and unacceptable in the UK. Any individual who performs any breach under criminal law is liable for the criminal prosecution by the state. Generally, the criminal proceedings are heard in the Magistrate’s Court or Crown Court by Crown Prosecution Service. Burglary, Assault, theft, Sexual assault, arson, battery, Fraud, Drug dealing and criminal damage are examples of criminal offences (England, 2017). On the other hand, the actions under civil law affect an individual or group of persons only. A person breaches any legal duty or performed any negligence which causes breach of any contract or agreement is known as a breach under civil law. It involves the area of contract, negligence, probate, employment, family matters and land law (Wilson, and Popp, 2017).
Overview of the sources of law in the United Kingdom
In the United Kingdom, there is no single document or series of documents which includes the entire UK law. There are different sources of law which help to establish an appropriate law in the UK. The major sources of law in the UK include common law, European Union law, and legislation and European conventions of human rights. The principal legislature is the UK Parliament, the only body which has the right to pass laws that apply in whole state of the UK. Apart from the parliament legislation, the law of the UK also considers the decided case laws and their judgments for the creation of law and local legislation (Roberts, 2018). These laws and regulations needs to be undertaken by the organization to strengthen the corporate governance mechanism and avoid the possible issues.
