Legal Research Literature Review

These guidelines are for your consideration as you undertake your literature review. It is NOT necessary for you to answer every dot point in your final literature review.

• (1) On the basis of your research question, first establish:
•  what is the current law with respect to this topic?
•  what is the historical development of this law; that is, what has led to and contextualizes the current law?
• (2) Then, with the requirements of a literature review in mind (see Topic 3.6), consider the following as you undertake your extensive search of the literature:
•  on the basis of the current law, what are your initial thoughts about this topic? Do you have an initial sense of what you want to argue about it?
•  what is your methodological approach? Think about whether your argument is purely doctrinal (legal formalism), or do you want to make a more expanded argument (for instance, law reform, legal theory, critical analysis using Earth jurisprudence, etc.)?
•  what is the current state of knowledge with respect to the topic and your initial sense of your argument about it?
•  what are you searching the literature to discover?
•  what initial evidence exists that allows you credibly to advance your argument?

(a) To Start
This template is provided as one possible method for you to keep track of your source material as you undertake the research process. The purpose of each entry is to prompt you to reflect on the readings you have undertaken and to record your thoughts so they are readily available and easy to synthesise when you come to write the literature review itself.

Note: This template includes only one record box for each type of source – clearly you must include more sources than that (you can use this template to add more record boxes as you need them). The number of readings you have for each type of source is likely to vary.

(b) As you Proceed
As you proceed, reflect on the materials you have readings you have read and begin to identify the main connections and themes (this will assist you to structure your literature review). Consider:
o the connections and underlying themes addressed in the literature;
o whether the readings present consistent or contrary views on those themes? Can any differences be reconciled?
o the credibility of each reading and the authority of its author. Is that authority an expert in their field? How much weight should you attach to their argument?
