Cannabis is currently classified as a ‘Class C’ controlled drug under the Misuse of  Drugs Act 1975. This means that people cannot legally buy, sell, or use cannabis in  New Zealand.  

At the 2020 general election, voters were asked the following question in a non binding referendum: ‘Do you support the proposed Cannabis Legalisation and  Control Bill?’  

Amongst other things, the proposed law will: 

• through licensing and other measures, regulate and control the cultivation,  manufacture, use, and sale of cannabis in New Zealand 

• control the supply, content, quality, potency, and supply of cannabis

• establish a minimum age of 20 to grow cannabis for personal use, and to  purchase, possess and use recreational cannabis 

• regulate the environment in which cannabis may be grown 

• restrict access to cannabis and prohibit inducements to use cannabis

• improve access to health and social services for those requiring assistance to  address issues associated with cannabis use 

• establish enforcement procedures and penalties for infringements 

Assume that the referendum result in 2020 was in favour of the new legislation and  that the Bill is to be introduced into Parliament.

• how the new law will provide for the making of subordinate legislation: what that  is, its purpose, and who will be empowered to make it 

• the role the courts will have in relation to the new legislation once it has been  enacted and is in force 

• how the courts will resolve any ambiguity in the new legislation.
