1. Advise whether the following national laws are likely to breach EU law:

a. Cyprus has introduced new measures to regulate the scented candle industry. It requires that scented candles may only be imported into the country if they have a certificate attached stating that the candle contains 50?eswax, which is said to be more environmentally friendly than other sorts of wax. The Cypriot government has created a specialised agency, which is fully funded by the government and responsible to the environment minister, to carry out the certification process.

b. German law states that all scented candles must be sold in transparent glass containers. According to the German business minister, this is so the consumer can easily identify when their candle has run out of wax, thus preventing them from unnecessarily buying extra candles. Most German candle companies already sell candles in transparent glass containers, but the biggest Swedish and Danish companies, which sell slightly more candles in Germany than the German companies, do not.

c. The Lithuanian government is worried that the trend for scented candles may lead to more small fires in the home. Lithuania has now banned all advertising of scented candles on social media, on the basis that social media influencers are the major source of advertising for scented candles.

5. Discuss whether the European Union’s accession to the European Convention on Human Rights would improve the protection of human rights within the EU.
