Medical staff at a number of health facilities in Queensland have expressed uncertainty about law that relates to patients who are receiving life-sustaining medical treatment. Staff wish to have guidance on the following situation:

• an adult receiving life-sustaining medical treatment has injuries or illness from which they have no prospects of recovering;
• the adult is unconscious, and has no prospects of recovering consciousness;
• there is no immediate emergency, however the nature of the adult’s injuries or illness means that ongoing treatment will be required to keep the adult alive that doctors consider to be invasive;
• the adult has no advanced health directive, no health attorney, and no guardian appointed;
• family members wish doctors to provide all available treatments in order to keep the adult alive as long as possible;
• however, doctors’ opinions are that ongoing treatment will be overly burdensome, and ultimately futile, considering that the adult has no prospects of recovery.

The Queensland Health Minister has requested a report on the law that applies to this situation, which you will write. In the report:

1. identify and explain the current law (common law and statute) that applies to this situation;
2. describe the ethical interests involved in this law;
3. recommend whether the law should be retained or amended. Explain your reasoning.

The following areas of law are outside the scope of this assignment:

• Children’s consent for medical treatment
• Voluntary assisted dying
