Achara Superborn is 30 years old and a citizen of Thailand. She was working as a receptionist at the  German embassy in Bangkok. Achara met Jack Smithers, an Australian citizen, who has been working  in Bangkok for the last 3 years and they fell in love and have been living together for a year with her  son, Anurak, who is 11 years old. Anurak was born as a result of a one-night stand and has no other  siblings. Anurak regards Jack as his father. Achara’s elderly mother, who is 70 years of age and in the  best of health, also lives with them in Bangkok. Achara’s father passed away 4 years ago.  

Jack had to return to Australia as his mother had a severe heart attack and he has been living in Sydney  with her for the last 6 months. Achara and Anurak were missing him terribly. Achara applied for a Class  FA Subclass 600 Visitor visa which was granted for 3 months and she arrived in Australia 7 days ago.  Her visa has the following conditions on it: 8101, 8201 and 8501. Anurak remained in Bangkok in the  care of his grandmother.  

Jack and Achara decide that they cannot live apart. Achara informs Jack that Anurak is HIV positive  as a result of a blood transfusion performed in a hospital in Bangkok when he was younger and had  been run over by a car. Achara also informs Jack that the agent in Bangkok who assisted her with the  Visitor visa application told her not to include or mention Anurak in that application.
