Assignment 1
This assessment task assesses your ongoing active participation in weekly discussion forum activities and requires you to submit a reflection on your learning during the unit. You are assessed on whether you engage with the weekly discussion forums in a meaningful and timely way.
The reflection is a written piece with min 500 words max 750 words, and is due at the end of the semester.
This task contributes specifically to the development of students’ understanding of unit material and assesses Learning Outcomes 1-4.
LO1 Locate, navigate and interpret Migration legislation and identify the role of policy
LO2 Identify the jurisdiction of Tribunals and Courts with respect to visa cancellation and refusals
LO3 Research, formulate and implement appropriate strategies for providing concise and effective practical advice to clients
LO4 Apply advanced knowledge of the Code of Conduct and the ethical and professional obligations of a registered migration agent in client communication, drafting and advocacy to demonstrate expert judgment, adaptability and responsibility as a migration practitioner
ASSIGNMENT 1 – Reflective
The purpose of this assignment is to demonstrate my understanding of the lesson materials, discussion group, and weekly online forum. Most importantly, use the knowledge leaned to influence my future practice as a migration agent.
Introduction to Advocacy & Review
The Administrative Appeals Tribunal (AAT) is the Tribunal that considers Migration merits review but there are different parts in the Migration Act that deal with different types of review. Not every review in the AAT is dealt with under the same legal procedure, so it is firstly important to identity whether a review is possible and how that legally occurs.
Applications to the AAT are managed in one of eight divisions:
• Freedom of Information Division
• General Division
• Migration and Refugee Division
• National Disability Insurance Scheme Division
• Security Division
• Social Services and Child Support Division
• Taxation and Commercial Division, and
• Veterans’ Appeals Division.
The Migration and Refugee Division deals with the old Migration Review Tribunal (MRT) and the Refugee Review Tribunal (RRT) cases. These were formerly Part 5 and Part 7 respectively. Character and citizenship appeals are heard in the General Division of the AAT and are covered separately. Part 7AA reviewable decisions are dealt with by the Immigration Appeals Authority.
