Instructions 

You are expected to individually research and write a 2000 word essay based on the problem scenario. Students are required to use the IRAC method within an essay format. You must cite legal authorities to support your arguments in answering all of the questions and reference using the USP School of Law Referencing Guide. 

You are encouraged to use cases covered in the course materials, but it is expected that students illustrate an acceptable level of independent legal research from legitimate and credible legal resources, such as legal databases available through USP library. Legal research should NOT be a Google search and/or Law Teacher and other such websites. 

You do not need to submit a Plagiarism Coversheet or a title page. The heading of your assignment must include your name, ID number and mode of study. Students are to use a 12 pt font (Arial or Times New Roman) with 1.5 line spacing and page numbers. Do not use page borders, fancy or coloured fonts in your submission. 

Your assignment must be submitted into the Moodle dropbox before the due date. Any requests for extensions must be made before the deadline and must be supported with evidence. Failure to comply with University and School of Law policies relating to plagiarism and submission times, as well as the stipulated word limit, will result in the reduction of marks. 

Natasha received a scholarship to study law at the University of Pacifica. She was from the neighbouring island nation of Lilika, which was located south of Pacifica. In her second year of study, she met Bruce. Bruce was from Pacifica and was studying to be a civil engineer. They soon fell in love and decided to get married after they graduated. Natasha decided that she would move to Pacifica to be with Bruce. 

Three months after graduation and her marriage to Bruce, Natasha submitted an application to the Director of Public Prosecutions Office for a Prosecutor position. She was shortlisted along with 3 other candidates from Pacifica and interviewed on 10 August 2020 by the Minister of Justice, Steve, the DPP Office Manager, Tony, and the Director of Public Prosecutions, Carol. Steve, Tony and Carol were impressed by Natasha’s application and interview and decided to offer her the job. 

The next morning, an anonymous profile called Pacifica Whispers, posted the following status to a public Facebook forum: 

Accompanying the post was a photo of Natasha and Bruce at graduation. 

On 14 August 2020, the local newspaper, Pacifica Daily News, published the status in their ‘Letters to the Editor’ column. The status was printed word for word in the column. However, the newspaper omitted the photo of Natasha and Bruce. On 18 August 2020, the Leader of the Opposition, Thanos, mentioned the post during a Parliamentary debate: “Honourable Speaker, we need to have accountability. This Facebook post about the DPP is a good example of how we need to stamp out corruption in our Government. The DPP is from Lilika and that new prosecutor is too. This is nepotism at its finest. Don’t we have qualified people in Pacifica for these positions?” 

Seeing the viral Facebook posts, the newspaper column and the Parliamentary debate on TV caused great distress to Natasha who was two months pregnant at the time. As a result of the stress, Natasha suffered a miscarriage.
