Answer the following problem-based question:

Tomaroma Ltd is a tomatoes supplier in the UK. Its stock in its warehouse a week ago was:

  • 100 kilos of Santorini Tomatoes;
  • 200 kilos of Cherokee Purple which, unknown to Tomaroma Ltd, were the last ones for the season;
  • 350 kilos of Big Beef;
  • assorted tomatoes.

In the last week, Tomaroma has made and received no deliveries of tomatoes, but has made the following agreements to sell tomatoes:

  • ‘100 kilos of Santorini Tomatoes’ to Hotel Eden;
  • ‘200 kilos of Cherokee Purple’ to Food Town Ltd;
  • ‘300 kilos of Big Beef, currently in Tomaroma’s warehouse’ to Good Bite Co.;
  • '50 kilos of Big Beef’ to Restaurant Gofoodie.

As regards payment: Eden paid Tomaroma when it made the contract; Food Town Ltd agreed to pay upon collecting the goods from Tomaroma’s warehouse; Good Bite Co. and Gofoodie each agreed to pay upon delivery by Tomaroma to their respective premises.

Yesterday, Tomaroma despatched to Gofoodie 50 kilos of Big Beef. Unfortunately, the lorry (Tomaroma’s own) crashed en route and fell in the river and all the tomatoes on board were lost.

Last night, a fire destroyed Tomaroma’s warehouse and its contents.

Advise Hotel Eden, Food Town Ltd, Good Bite Co. and Restaurant Gofoodie, as to whether, and when property and the risk in the goods had passed to them.
