Imagine you work as a freelance designer for your client, SpotOn: a chain of mid-range department stores which sells clothes, toys and homewares. SpotOn has stores across the country and is known for offering on-trend goods at discount prices.

The client has asked you to work on some designs for SpotOn’s new range of t-shirts, and you are excited about the opportunity. He shows you three images, which you think are for inspiration, but instead, he directs you to alter the existing images just enough to get around the ‘substantially similar’ provision under intellectual property law. This is part of SpotOn’s new business model, which they believe gives them a competitive advantage. 

One of the images is by a small, independent designer; one is a logo used by a celebrity to market her recent world tour, and the other is a sacred symbol used by an ethnic minority group. Additionally, the client has put a rush on this brief but has stated they are not able to pay rush fees or any additional costs.

Your task for this assessment is to write a report for your client outlining how your position in response to their brief, and the reasons behind your decisions.

 

Activity 

Prepare a report of 1500 words outlining how you would respond to your client, and why. In order to do this, you will have to conduct research into each of the ethical issues posed in the problem, think about how you would approach each issue, and make a case using evidence to back up your decision.

Before you begin writing, you will need to look at some sample business reports, in order to understand the format. Reports are different from essays, in that they are divided into sections with headings, to make information easy to find. Some of the sections in a report could include a title page, executive summary, table of contents, introduction, body, conclusion and reference list. The body section might be further broken down into sub-sections for each argument or main point. You will need to use all of your design skills in order to communicate the message clearly and succinctly.
