Mr. Vijay had his immovable property in Pune as well as in Mumbai. He had one daughter Mrs. Shivani and one son, who had pre-deceased him Mr. Vijay executed a Will on bequeathing his Flat at Prabhat road and a commercial shop bearing No. 3 at commerce avenue at Aundh and property in Vile parle in favour of his Grand-daughter(daughter of a pre-deceased son). Mr. Vijay did not register the Will. The Grand- daughter came to know about the execution of the Will after the year of the death of Mr. Vijay. Immediately she filed an Application for probate but did not implead her Aunt in the case. The Court granted a Probate in favour of the Grand-daughter. Aggrieved by the decision of the Court granting probate, Mrs. Shivani decided to seek relief by filing a case in competent Court. Being a lawyer assist Mrs. Shivani to file a case
